The vision for this CLE is to help practitioners with the multitude of issues that arise following a criminal conviction.
Obviously, one of the first steps following a criminal conviction is sentencing. Panelists provide a prosecutor's perspective and a defense attorney's perspective on sentencing and how they craft their sentencing argument for the judge.
In New Hampshire, following a contested sentencing hearing under certain circumstances, either the State or defendants have the right to appeal to the Sentence Review Panel to have a New Hampshire State Prison sentence reviewed by a panel of Superior Court judges. Here, panelists include Hon. J. Temple and Clerk of the Sentence Review Division Holly Aquizap. They discuss the sentence review process and their thoughts and perspectives on it.
Following a conviction, defendants sometimes contest the validity of their convictions by asserting that they received ineffective assistance of counsel. Two panelists present a prosecutor's approach and a defense attorney's approach to ineffective assistance of counsel hearings.
A panelist presents on some of the post-conviction writs and motions. The discussion will include Writs of Habeus Corpus, Writs of Coram Nobis, Writs of Coram Vobis, Motions to Suspend Sentences, Motions to Amend Sentences, among others.
Attorney Mark Sisti presents on annulments and pardons. He discusses his practical experience with pardons and the various steps in successfully obtaining an annulment of a criminal conviction.
Lastly, a panelist presents on ethical issues that arise post-conviction. This topic includes ethical obligations of prosecutors post-conviction, particularly in regard to newly discovered evidence. Additionally, confidentiality issues for defense attorneys is addressed.
