This panel discussion presents issues related to obtaining discovery in criminal cases from law enforcement and other sources. It discusses best practices in review and identification of privileged matters and use of triggers and ticklers to remind law enforcement and others of our responsibility to provide discovery. Lastly, we discuss best practices for identifying any privileged materials as well as 404(b) materials and segregating same as well as provision of materials to opposing counsel in a thorough and timely way.
