In November 2016 the NHBA Labor & Employment Law Section had a session on marijuana law. This will be a repeat of that presentation.
New Hampshire passed medical marijuana legislation in June 2013 which provides an exemption from criminal penalties for the therapeutic use of marijuana for “Qualifying Patients” with one of several enumerated medical conditions. The medical marijuana law has only recently gone into full effect, however. The Department of Health and Human Services began issuing Registry Identification Cards to Qualifying Patients on December 28, 2015. New Hampshire’s first medical marijuana dispensary opened in April 2016 in Plymouth. Three other dispensaries have since opened in Merrimack, Lebanon and Dover.
Medical marijuana remains an illegal Schedule I drug under federal law, creating a conflict with state law. With a view toward this conflict, this program will discuss employer’s options for dealing with employee use of medical marijuana and accommodation, as well as a discussion of workers compensation issues and whether workers compensation insurers are required to pay for the costs of medical marijuana.
