6/2/2021 - Traps for the Unwary: Automobile Accidents
NHBA•CLE and the New Lawyers Committee are pleased to bring you a series of short programs from the New Lawyers Committee "Traps for the Unwary" publication.
This class discusses the different types of injury claims that can be made if a person is injured in a car accident, and the regulations that go along with making each type of injury claim. We discuss the liability and evidentiary requirements for making a personal injury claim following a car accident. This includes RSA 265, the importance of proving causation, how expert testimony can be used to prove medical causation, and how to make a claim for loss of earning capacity.
The difference between underinsured motorist coverage and uninsured motorist coverage is reviewed, and the necessary steps an attorney must take when their client elects to use first party insurance coverage. We discuss when each of these coverages can be used, and how to determine how much coverage is available. Some of the topics in this area include the need to request to settle an underlying bodily injury claim from the client’s insurance provider, the required language that must appear on all settlement releases in New Hampshire, who can recover underinsured motorist benefits, and whether or not the “stacking” of insurance policies is allowed in New Hampshire.
A review of medical payments coverage or “medpay” is provided. We discuss how to use medpay to your client’s advantage and explain the client’s opportunity to choose to whom to submit a claim, and how to coordinate payment for their care.
Health insurance liens are an integral part of an injury claim that cannot be overlooked. We discuss some of the steps that an attorney must take to address and resolve Medicare liens, Medicaid liens, and private health insurance and ERISA Plan liens. Who Should Attend? Attorneys that are new to the personal injury / car accident field of law who would like a broad overview of the different types of coverages available to their clients, and how to use those coverages to their clients benefits, and what some of your responsibilities are to your client and in resolving health insurance liens.
