In this program, faculty lead an interactive and provocative discussion about the concept of "assent" or "consent" under modern consumer contract law. The central contention is that consumers are being incapacitated, and even infantilized, by modern commercial practices and the commercial laws that support them. These practices overrun consumers and, effectively, deprive them of important rights established by public processes and constitutional law. They also examine the concepts of assent, consent and affirmation as they are applied to individuals of varying levels of sophistication in the areas of housing, public benefits, family law, and elsewhere. Solutions abound, including through advances in technology.
